Civil rights organisation AfriForum is heading to the Western Cape High Court on Monday to challenge the constitutionality of South Africa’s Expropriation Act.
The hearings, which run from 2 to 4 March, will determine how various parties will participate in the case, including who may join as respondents or applicants.
AfriForum is set to argue that the Expropriation Act, which allows for expropriation without compensation, threatens private property rights in the country.

The organisation said this early phase of the court process is crucial in shaping how the broader constitutional challenge will unfold.
Meanwhile, a Khoi San movement has filed an urgent application at the same court to halt the City of Cape Town’s R135 million public land auction, which includes the planned sale of the Good Hope Centre.
The movement will argue the city acted unlawfully by proceeding with the auction last week while a court appeal was still active.
