Modack trial: Judge tells police captain he was misled by alleged underworld gang boss

Western Cape High Court judge Robert Henney has told a captain in the South African Police Service he was being misled by alleged underworld gang boss Nafiz Modack.
Captain Alfred Barker is being cross-examined by the state about his relationship with Modack.
Modack, who faces 122 charges related to allegedly operating a criminal enterprise insists Barker was part of his plan to expose certain top cops --and underworld figures who were working against him.
Barker, on Tuesday, told the court he never gave Modack instructions to pay top cops Jeremy Vearey and the slain Charl Kinnear in a plot to expose them for alleged corruption.

State prosecutor Blaine Lazarus questioned Barker about why Modack testified that the captain gave him guidance and instructions on how to expose Vearey and Kinnear.
Barker told the court that while he investigated Modack's allegations, he was never part of a plan to expose the senior police officers.
Judge Henney told Barker that evidence shows Modack led him astray.
"Facts were not given to you. Facts were withheld... You were misled, you were never told about the other payments. He lets you open a docket..."
Barker told the court his relationship with Modack was that of a police officer investigating allegations made by a complainant.
