JOHANNESBURG - Lawyers for Thabo Bester and Dr Nandipha Magudumana said they were disappointed in the outcome of a legal bid to have the broadcast of a Netflix documentary about them halted.
On Friday morning, the Pretoria High Court struck the application by the pair from the roll for lack of urgency.
The documentary aired on Friday morning on Netflix after the court’s ruling.
The court slapped both Magudumana and Bester with a cost order despite the doctor’s lawyers arguing that they struggled to consult with her in prison, which resulted in delays when filing their court papers.
Magudumana’s lawyer, Dinana Reed, said they still believed in the strength of their case.
"They are heavy costs, especially when you look at the fact that the client is based in Kroonstad – it's not an easy type of consultation to do. There are processes that one needs to follow. You can’t even consult after hours."
