Kevin Jacobs (spokesperson for the City of Cape Town's traffic services) explains what to do when someone parks across your driveway or garage entrance, and what regulations say about on-street parking.

'You have rights': What to do when someone blocks your driveway...

No Parking sign, 123RF

Lester Kiewit speaks to the City of Cape Town spokesperson for traffic services, Kevin Jacobs.

It's frustrating, but it frequently: drivers parking off-street, blocking residents' garages and driveways.

You do have rights, and you can do something about it!

"This goes against your property rights as someone living or renting the home. People have a right of access to their property and we [Cape Town Traffic] will gladly move that obstruction for you."

Legally, you can't park in front of someone's residential gate - even if there is space for parking.

Residents may not clamp the car blocking their driveway or take the law into their own hands, but you can call the City who will deal with the issue because there is legislation that empowers it to act.

"It becomes our concern once they block your driveway. What you can do is call the City. Call Cape Town Traffic and we will come and remove the vehicle. If there's an obstruction, we'll gladly do that. If there is an ongoing challenge, we will engage the offender or neighbour to try and resolve the issue."

Off-street parking works on a first come first serve basis. It may not be reserved; it's an offence to try.

"You can't reserve access for off-street parking unless you have an event in which case, you'll need to apply for a permit from the City which will be valid for a limited time only."
