The MK Party is also challenging President Cyril Ramaphosa’s decision to place Minister of Police Senzo Mchunu on special leave after damning allegations made by KwaZulu-Natal Police Commissioner NhlanhlaMkhwanazi.
Thursday marks day 2 of the police commission of inquiry, and the MK Party will be in court trying to get it interdicted from proceeding.
The party and its leader will argue before a full bench that Ramaphosa was biased, acted in bad faith, was dishonest, and had improper motives
The party also claims the president violated his constitutional obligations when he placed Mchunu on special leave and appointed Firoz Cachalia as acting police minister.
The president insists he has dealt with Mchunu in accordance with his constitutional powers, and there was no bias or special treatment.
The party also questions why a judicial commission of inquiry with members of the judiciary is set up to investigate allegations made by Mkhwanazi.
