The murder-accused brothers, Ferrel and Darren Govender, appeared before the court to apply for bail.
But the State in the case said it wanted to refer the matter to KwaZulu-Natal Director of Public Prosecutions Elaine Harrison on what schedule the bail should be.
This as the case could fall under both schedule 5 and 6.
The pair who are also security bosses are alleged to have called Singh into a meeting and allegedly shot him.
The matter will return to court for an update on consultations with the DPP.
