State challenges admissibility of one of the accused's bail application in AKA & Tibz murders

DURBAN - The State has challenged the admissibility of one of the accused's bail application in the murder of Kiernan "AKA" Forbes and Tebello "Tibz" Motsoane. 

On Monday, two of the seven men arrested in connection with AKA and Tibz’s murders appeared in the Durban Magistrates Court. 

Taxi owner, Lindani Ndimande, made his application for bail but the State halted proceedings when it was time for Durban businessman, Mziwethemba Gwabeni, to apply for bail. 

This after prosecutor, Advocate Lawrence Gcaba, found emails he had sent to one of the defence attorneys contained in Gwabeni's bail application.

"Hence, I was shocked when I saw that my emails formed part of accused number four's application." 

Gcaba said there were also documents pertaining to the two men arrested in Eswatini as part of Gwabeni’s bail application. 

"I’m here to understand on what basis does a charge sheet or court record from another country forms part of these proceedings under which section." 

Gwabeni's lawyers have been given until Tuesday to amend his bail application and present it to court.
