Public Protector's office confirms receipt of Mkhwebane's court papers over R10m gratuity

CAPE TOWN - The Public Protector’s office has confirmed receipt of court papers from former Public Protector-turned Economic Freedom Fighters (EFF) Member of Parliament (MP) Busisiwe Mkhwebane in respect of an end-of-service gratuity she believes is due to her. 

Mkhwebane approached the high court after a letter of demand sent to that office to pay her around R10 million did not have the desired outcome.

In her court papers, Mkhwebane wants parts of the conditions of service for Public Protectors to be declared unconstitutional and invalid, and for it to order that she be paid. 

The conditions of service for Public Protectors' passed by Parliament in 2002 state that they are due a gratuity calculated on a prescribed formula upon vacating office. 

Mkhwebane was impeached by Parliament last September, weeks shy of completing her seven-year term. 

Acting Spokesperson for the Public Protector’s office said that it has received Advocate Mkhwebane’s court papers, and will attend to the matter accordingly. 

"No further comment will be made regarding this matter at this time."

Mkhwebane also cited the president, finance minister, and speaker of the National Assembly in her court papers.
