National Assembly backs decision to fire Jiba, Mrwebi from NPA
Parliament would not be recommending that either of them be restored to their posts at the NPA.
Parliament’s justice committee on Tuesday decided there were no compelling reasons to recommend that they should be restored to their positions at the NPA.
Parliamentary legal advisor Siviwe Njikela told the committee that legally, there was nothing stopping it from going ahead, even if Jiba were to appeal the court’s decision against her being reinstated.
Jiba had asked the court to order President Cyril Ramaphosa and the National Director of Public Prosecutions Shamila Batohi to reinstate her to the deputy national director of public prosecutions.
On Friday, the court dismissed Jiba's latest attempt to get her job back as deputy director of public prosecutions with costs.

Papers were served on National Assembly Speaker Thandi Modise on Monday.
Jiba wants the process put on hold because she has gone to court seeking a review of Ramaphosa’s decision to sack her and also to set aside the findings of the Mokgoro Commission, which recommended that she and her former NPA colleague, Lawrence Mrwebi, be dismissed.
It will not be just another week for ordinary MPs, as President Ramaphosa will also expect a rowdy reception when he returns to the assembly to answer questions on Thursday.
Former NPA boss Mxolisi Nxasana returned to the state capture inquiry on 19 August 2019. Nxasana told the commission details of the events that led to him stepping down from his position.
Portfolio Committee on Justice and Correctional Services chairperson Bulelani Magwanishe said the committee would continue with its programme as members had not been formally informed or interdicted from going ahead with the process.
Former prosecutions boss Mxolisi Nxasana said that the campaign to oust him went as far as Zuma, who was then the president.
Jiba filed an application to review the president's decision and Judge Yvonne Mokgoro's finding that she was not fit for office.
The two were sacked by President Cyril Ramaphosa on the recommendation of the Mokgoro commission which investigated whether the pair were fit for their jobs.
Parliamentary legal adviser Siviwe Njikela said that Parliament’s job was to consider whether President Cyril Ramaphosa acted within the law in axing former NPA officials Nomgcobo Jiba and Lawrence Mrwebi.
Member of Parliament Glynnis Breytenbach, a former prosecutor employed by the NPA, testified against both Jiba and Mrwebi at the Mokgoro Commission of Inquiry.
Outa said it was disappointed by Thursday’s Constitutional Court’s decision, which upheld a Supreme Court of Appeal ruling to keep the pair on the roll of advocates.
