SAA BRPs cannot be law unto themselves, says Gordhan
Minister Pravin Gordhan said changes in the Companies Act could help hold business rescue practitioners more accountable.
The unions want the court to compel the Public Enterprises Department and the airline's business rescue practitioners to pay over three months' deferred salaries.
Unions have slammed the officials for failing to prioritise workers’ livelihoods as they work to implement their rescue plan.
The union claims it's unlawful and unfair.
Business rescue practitioners at the troubled airline wanted the court to set aside a court decision to halt retrenchments at SAA until a business rescue plan is adopted.
The practitioners said that due to a lack of cash flow for SAA and with no cash injection coming from government or potential investors, the whole rescue process would fail.
Ina desperate bid to save one of the country’s largest clothing retailers, 22,000 employees were served with retrenchment notices.
They had originally aimed to publish the plan next Tuesday but have asked for this to be extended until 23 June.
The draft plan said the government had agreed to make a working capital injection, which the administrators estimated at not less than R2 billion, fund employee layoffs
This will be their fourth extension since taking charge of the embattled airline since December last year.
The criticism comes after Siviwe Dongwana And Les Matuson's decision to appeal the Labour Court's ruling, preventing their plans of cutting jobs at SAA from going ahead.
It's supposed to detail how government will form a new airline from the ruins of SAA, which will be shutdown.
SAA said it didn’t have enough money to continue paying salaries beyond this month.
The national carrier relied on government bailouts for years to stay afloat, however this week, it failed to secure funding from the Public Enterprises Department.
SAA's business rescue practitioners said that the consultations were imminent and all recognised unions had been informed.
In its plan, Satawu, which represents workers at SAA Technical, proposes that the airline should explore equity partnerships, which must include employee cooperatives.
The plan was expected to be published before the end of next week Friday.
The National Transport Movement said the plan should be released so that the airline’s employees could find closure.
KwaZulu-Natal Premier Sihle Zikalala has lambasted the move, saying it did not make sense.
