Former Gauteng Health MEC Bandile Masuku is seeking to have the report declared unlawful, unconstitutional and invalid.
The former MEC was fired by Premier David Makhura in October last year after the SIU’s preliminary findings said that he had failed to provide oversight, to uphold the Constitution of the country and the regulations in the Public Finance Management Act.
The pair were charged two weeks ago and Masuku has made those charges public.
Former Gauteng Health MEC Dr Bandile Masuku was found by the SIU to have failed in executing his functions in with the country’s constitution and the Public Management Finance Act.
ANC provincial secretary, Jacob Khawe, confirmed to Eyewitness News that the two had received their charges, with a pre-hearing already set down for 14 December.
The African National Congress (ANC) in Gauteng gave Makhura until on Tuesday to replace Bandile Masuku.

Gauteng ANC deputy provincial chairperson, Panyaza Lesufi, said that while the provincial executive could not tell Premier David Makhura who to pick, it could urge him to do so quickly.
Provincial Treasurer, Parks Tau, said that the process would now follow rule 25 of the ANC constitution in dealing with the two.
