‘Racial classification has no place in our society’ – Free SA

The Foundation for Rights of Expression and Equality has raised concerns about what it says is the ‘reintroduction of racial classification' into public administration.

The Foundation for Rights of Expression and Equality (Free SA) has sent a formal letter of demand to the Chief Registrar of Deeds.

This is in relation to the Chief Registrar’s Circular No. 3 of 2025,which outlines
amendments to regulations under the Deeds Registries Act of 1937.

The foundation says this circular introduces a requirement which compels people involved in property-related transactions to disclose personal information. This includes their race, gender, citizenship, and nationality.

The circular says this data is for statistical and land audit purposes.

Maritz says this racial classification has no place in our modern society.

He argues that the principle of willing buyer and willing seller should be enough to regulate land-related transactions.
