CAPE TOWN - Retired top cop Jeremy Vearey says alleged underworld gang boss Nafiz Modack was a victim of a "long con" by a middleman, which Vearey and his slain colleague, Charl Kinnear, were aware of.

The Western Cape High Court on Thursday heard how Modack was approached by a middleman to bribe Vearey and Kinnear.

Modack, along with 14 others, faces 124 charges related to various crimes, including the murder of Kinnear.

Evidence presented in court included a statement from Modack to police, which the State used to try and implicate Modack on charges of corruption and defeating the ends of justice.

In the statement, Modack agreed to pay middleman Mohamedaly Hanware bribes to Vearey and Kinnear to return firearms seized from his home during a raid in 2017.

Evidence shows after making various payments to Hanware's wife, Caitlyn Bowen, with Vearey as a reference, Modack's money trail ends with no transactions to Vearey nor Kinnear.
Vearey said when he and Kinnear became aware of Hanware's alleged con, they reported it immediately.

"Modack was the subject of a long con by the middleman... We reported those matters. So, there was never any money transferred to us."

In another alleged bribe for the return of seized firearms, Modack claims Kinnear collected a bag of money from him following a meeting in the Cape Town CBD.

The trial continues.
