Modack trial: State to present arguments against withdrawal of charges application

JOHANNESBURG - State prosecutors are to present arguments on Wednesday against various applications for the charges against alleged underworld gang boss Nafiz Modack and his co-accused to be withdrawn.
Modack and his 14 co-accused this week submitted discharge applications to have the State's case against them withdrawn.
The accused face 122 charges for various crimes related to allegedly operating a criminal enterprise.
Judge Robert Henney dismissed attempts by defence attorneys for Modack's co-accused to discredit the State's main witness.
A self-confessed hitman previously testified against Modack, implicating several of the accused in various crimes.

Defence attorneys for eight of Modack's co-accused asked Judge Henney to disregard the witness's testimony because he lied under oath.
Henney told the defence he could not discredit the witness's entire testimony even though certain elements were in doubt.
