The accused in the Zanzou assault matter has been granted R10k bail.
MagistrateMbembele says he does not believe the 41 year old Congolese national will abscond.
The magistrate says because he has a temporary asylum seeker visa, he is in the country legally.
He was arrested following the circulation of videos showing young men being sexually violated by bouncers at the Pretoria nightclub.
While opposing bail for the accused, the State argued that the man was a flight risk as he was able to enter the country without valid travel documents and only applied for asylum once he was in the country.
But Magistrate Ernest Mbembele was not convinced.
Mbembele also rejected the argument by the State that the accused previously said that he feared for his life.
The accused will be released as soon as he pays the R10,000 and would return to court in May.
Mbelele also rejected the State’s submission that he would interfere with witnesses if released.
However, the court ruled that he is in the country legally because he has a temporary asylum permit.
Mbembele addressed the State’s claim that the accused would interfere with the case.
“The State alleges that he will interfere with witnesses, but the investigating officer States that he does not know the witnesses nor does he know their addresses so that is highly unlikely.”
