The Labour Court has dismissed an urgent application by suspended Ekurhuleni Metro Police Department (EMPD) deputy chief Julius Mkhwanazi to interdict his disciplinary hearing.

The embattled top cop had approached the court, hoping he wouldn’t have to answer to the City of Ekurhuleni for his alleged dodgy dealings.

Mkhwanazi has been at the centre of allegations of police corruption at the Madlanga Commission of Inquiry.

He’s accused of having links to suspected crime boss Vusimuzi “Cat” Matlala and fraudulently registering Matlala’s private vehicles under the city’s name.

In his application to the Labour Court, Mkhwanazi argued that his pending disciplinary hearing would be unlawful.

His argument was based on the fact that his alleged crimes and collusion with Matala were premised on a previous contract that has since been terminated.

Mkhwanazi argued that the City of Ekurhuleni has no jurisdiction or authority to discipline him for matters that occurred under a contract that no longer exists.

However, the court has ruled that his argument is without merit.

It found that a change in contract and position does not extinguish the city’s authority to discipline for misconduct conducted under a previous contract.

It said Mkhwanazi, in his application, failed to demonstrate that the pending disciplinary proceedings would be unlawful.
