Nafiz Modack trial postponed as defence lawyer falls ill

The high-profile trial of alleged underworld gang boss Nafiz Modack was postponed again on Monday due to one of the defence attorneys being ill.

Modack is on trial along with 14 others for various crimes, including the murder of top cop Charl Kinnear.

Three botched attacks on Kinnear and his family became the subject of proceedings on Monday when the accused made another brief appearance in the Western Cape High Court.

Nafiz Modack's lawyer, Advocate Bashier Sibda, was due to re-examine Modack after the state closed its case against the alleged underworld gang boss in November last year.

However, proceedings were postponed for a second time in a week because defence attorney Advocate Pauline Andrews was absent due to illness.

The court agreed Andrews needed to be present in court to defend her client, co-accused Amaal Jantjies.

It is the state's case that Modack paid Jantjies to orchestrate Kinnear's murder, but her plans failed when she was arrested after three botched attacks on Kinnear at his Bishop Lavis home in 2019.

Presiding Judge Robert Henney postponed proceedings to 13 February for Andrews to be present.
