Madlanga Commission: Explosive testimony raises new questions over state involvement in Sindiso Magaqa murder

Shocking testimony at the Madlanga Commission this week has sparked concern about the influence of crime intelligence in the murder of former ANC Youth League (ANCYL) secretary Sindiso Magaqa.
The witness testified that he received information directly from the gunmen that they were hired to kill Magaqa.
Magaqa and two fellow councillors were shot in July 2017 after a council meeting in KwaZulu-Natal.
He died weeks later following complications linked to the attack.
In July 2025, hitman Sbusiso Ncengwa was sentenced to 25 years’ imprisonment for the murder.
Commission chair Justice Mbuyiseli Madlanga pressed Witness E on why they failed to prevent the shooting.
The witness said the alleged masterminds behind the shooting were identified by the gunmen as his superiors.
Whistleblower Thabiso Zulu, a friend of Magapa, said the family has always known that crime intelligence was involved.
“We have always known that the police were involved. Even among the accused, who are currently in the dock, there are two former policemen.
“I know Witness E by name; we have had his affidavit for some time, and the state has had his affidavit for some time. That says the state is not willing to arrest them.”
Witness E also produced an audio clip in which suspended Police Minister Senzo Mchunu allegedly coerced them to lie before the Commission.
Mchunu can be heard promising the witness a ‘free and happy life’ should they comply.
Independent crime and violence analyst Dr Chris de Kock explained that, while these are allegations and are set to be proven in court, the testimony is quite daming for the minister.
“Even the Commission may decide to call him back because, clearly, this is very serious and actually tampering with the witness and with evidence.”
