The case involving the bail amendment for Crime Intelligence boss, Dumisani Khumalo, has been postponed to November.
Khumalo and two others appeared before the Pretoria Regional Court on Wednesday morning on charges of fraud and corruption.
They are accused of being involved in the appointment of Dineo Mokwele to an executive position within Crime Intelligence, despite her not having any previous policing experience.
The trio wants to have their bail conditions relaxed so that they can return to work.
But the case could not proceed on Wednesday because the State indicated they planned to make an application to the high court to set aside the decision for Magistrate Vusumuzi Mahlangu's recusal.
On Tuesday, Mahlangu recused himself from hearing the matter following allegations made against the judiciary before the Madlanga Commission.
The matter has been adjourned to 6 November to allow the state to file an application to have the decision for Chief Mag, Vusimuzi Mahlangu, set aside in this matter. Mahlangu recused himself as the magistrate presiding over the matter yesterday.

Mahlangu recused himself after his motives in this matter were questioned by Lt-Gen Mkhwanazi in the Madlanga Commission. There was, however, no application made by either the defense or state for Mahlangu to recuse himself in the matter.
