A number of sectional titles and residential estates are reportedly engaged in battles around short-term rentals.

If a person owns a property in a residential estate or sectional title, trying to lease your property in the short term can be complicated.

In the case of Blyde Riverwalk Estate in Pretoria, several property owners began renting out their property in an Airbnb style during the Covid-19 lockdown.

This led to numerous complaints from permanent residents, and eventually the Homeowners Association banned these rentals without trustee consent, and the case eventually went to court.

Regarding the rules around short-term letting, senior community schemes consultant Nicole Nel says body corporates can make whatever rules they see fit, provided they follow the correct legal procedures.

She adds that the issue usually does not relate to the short-term rentals themselves, but rather the behaviour of the renters.

“It is so down to the unique set-up of the scheme, and what your members want.”
