JOHANNESBURG - Lobby group AfriForum has accused judges of using personal ideologies to interpret the Constitution.

The organisation expressed disappointment in a Constitutional Court order that dismissed its application for leave to appeal a judgment that found that the song ‘Kill the boer’ did not constitute as hate speech.

The Supreme Court of Appeal (SCA) found that when chanting the song, Economic Freedom Fighters (EFF) Leader Julius Malema used a historic struggle song, with the related performance gestures to advance his party’s political agenda.

The Equality Court first delivered judgment in the matter in 2020, dismissing AfriForum's appeal.
The Constitutional Court’s order now brings finality to the matter.

AfriForum CEO Kallie Kriel said that, "This decision of the court to allow somebody to sing that Afrikaners can be killed, the fact is we are seeing the radicalisation in the interpretation of the Constitution. We see more and more ideologically driven judges. This, together with the fact that the presidency as well as the government refuses to condemn these slogans that call for the killing of Afrikaners means that we are on our own.
