BHF disappointed with Motsoaledi publishing draft regulations for NHI Act, despite several court challenges

JOHANNESBURG - The Board of Healthcare Funders (BHF) has expressed disappointment with Health Minister Aaron Motsoaledi's decision to publish draft regulations for the National Health Insurance (NHI) Act, despite several court challenges.

This week, the BHF's legal action against the department was heard in the North Gauteng High Court in Pretoria. 

The organisation is seeking a court review, to set aside President Cyril Ramaphosa's decision, to sign the bill into law.

In addition, various political groups are also challenging the NHI Act in court, raising questions about its overall constitutionality. 

BHF managing director Katlego Mothudi said they were currently studying the published regulations.

“This brings to question the government’s intent and pronouncements it made recently to collaborate. It is thus disappointing that, instead of working with the private healthcare sector to find sustainable ways to address the urgent healthcare needs of the country, they forged ahead with the implementation of the highly contested NHI Act. The BHF will further study the published regulations before making a detailed submission.”
