Earlier this week, Modack's lawyer, advocate Bashier Sibda, told the court his client had requested more time to prepare his testimony.
Modack asked the court for a week to prepare his evidence-in-chief, with Sibda saying he was not ready to take the stand.
The State argued that since the trial started in April 2024, Modack and Sibda have had more than 60 hours of consultation.
Judge Robert Henney agreed, saying he had granted more than 30 orders for Modack to consult with Sibda.
Henney adjourned the matter for Sibda to consult with Modack on whether he would proceed with his testimony.
