CAPE TOWN - Judgment has been reserved in yet another court battle between housing activists, Reclaim the City, and the Western Cape government related to the Tafelberg school site in Sea Point.

The housing movement initially hauled the provincial government to the high court in 2017 for selling the land instead of using the site for social housing.

The matter has since been heard in the supreme court before ending up in the Constitutional Court on Tuesday.
 
Reclaim the City is appealing a supreme court decision that allows the Western Cape government to redevelop the Tafelberg site in Sea Point.

The housing movement's legal arm, Ndifuna Ukwazi, said the case highlighted equitable access to housing on urban land.
 
Ndifuna Ukwazi's Disha Govender said the Western Cape government had failed to fulfill its obligation to redress spatial apartheid.

"We argue that people should be allowed to meaningfully participate in the decisions about land and that equitable access to land and adequate housing is required to achieve the society envisaged by our Constitution."

The provincial government said it would issue a response once judgment was handed down.
