Nafiz Modack's lawyer, Bashier Sibda, on Monday requested one more week for Modack to prepare his evidence-in-chief.
Modack had been due in the dock two weeks ago but asked for more time to prepare.
Judge Robert Henney granted the request and instructed accused two, Zane Kilian, to testify.
But after Kilian's testimony ended, Modack again requested time to consult with Sibda.
Henney told the court he had granted about thirty orders for Modack to consult with Sibda since the trial started in April last year.
The judge denied Modack's request for one week instead granting him one day to consult with Sibda.
The matter will be in court on Wednesday for Modack to decide whether he will testify.
