DURBAN - Economic Freedom Fighters (EFF) KwaZulu-Natal provincial leader Mongezi Twala will spend another night behind bars after another magistrate ditched the case.

Twala and four others were arrested for a disruptive protest which resulted in damaged infrastructure at the uMhlathuze Local Municipality last week.

EFF supporters marched to the municipality with the aim of disrupting a council meeting to demand that three of their six seats be declared vacant in council.  

The accused were meant to apply for bail in the matter but was adjourned to allow for a new magistrate to hear the case.

EFF KwaZulu-Natal provincial chairperson, Mongezi Twala, and four co-accused are yet to apply for bail in their public violence, and malicious damage to property case.

On Monday, the matter was rolled over for Tuesday for a new magistrate to be appointed.

However, upon arrival, Magistrate Vincent Hlatshwayo also had to recuse himself.

One of the accused, Sabelo Khubisa, happens to be an attorney who works in the same court.  

Having consulted with the relevant authorities, Hlatshwayo said a new magistrate from KwaDukuza would be sent to preside over this case.

This means the five accused will only apply for bail on Wednesday.
