CAPE TOWN - A defence attorney for alleged underworld gang boss, Nafiz Modack, has submitted an application to have the charges against Modack withdrawn.
Modack and 14 others face 122 charges for various crimes related to allegedly running a criminal enterprise.
The 15 accused returned to court on Tuesday after more than a month of recess.
Defence advocate for Nafiz Modack, Bashier Sibda, on Tuesday, tried to cast doubt on several of the State's witnesses against Modack.
Modack faces several charges related to incidents of attempted murder, murder, corruption, extortion and money laundering.
Sibda is arguing to have the charges against Modack withdrawn, saying that at least three of the State witnesses lacked credibility.
Judge Robert Henney told Sibda that while certain aspects of the witnesses' testimonies may be problematic, he could not ignore all the other evidence against Modack.
The trial continues.
