JOHANNESBURG - The African National Congress (ANC) says disgruntled Gauteng and KwaZulu-Natal (KZN) members are welcome to approach the courts to appeal the party's decision to reconfigure their leadership structures.

On Monday, the party announced its decision to reconfigure the provincial executive committees of Gauteng and KZN.

This follows the ANC's poor electoral performance in the two provinces in the May 2024 polls. Both regions failed to clinch an outright majority of votes.

Speaking at a media on Monday, the ANC’s Secretary General, Fikile Mbalula, said the decision was taken by the party's highest decision-making body and cannot be appealed within the organisation's constitution.

"Can the PECs (provincial executive committee) appeal? Appeal what because this is an intervention by the highest structure, but because we are litigious other people can go to court and all of that, but we are implementing the constitution and should anyone try and go to court, it means we must act guided by the constitution.

“If we don’t follow the constitution they will go to court and challenge the decision, but the decision taken by the NEC (national executive committee) will be implemented in the framework of the (ANC’s) constitution because if you don’t do that, they will have grounds to challenge it in court."
