State, defence in Mapisa-Nqakula corruption case agree over disclosure of documents

JOHANNESBURG - The State and defence in the corruption case of former National Assembly Speaker Nosiviwe Mapisa-Nqakula have reached a last-minute agreement over the disclosure of documents. 
 
Mapisa-Nqakula filed an application for the handover of six documents related to her case. 
 
They include Sections B and C of the police docket against her which is the investigation diary and correspondence between the investigating officer and prosecutor. 
 
The matter was back at the Pretoria Magistrates Court on Monday.
 
The State was initially against disclosing the requested documents, saying they were confidential and would not be used during the trial. 
 
However, defence lawyer Graham Kerr-Phillips said they reached an agreement with the State on Monday morning. 
 
“We were informed my lord, that the head of the Investigative Directorate has under the guidance and advice of (State prosecutor, Paul Louw), exercised the discretion, which we feel is the better side of valour, to effectively concede prayer one of application and disclose the B and C section of the State’s brief.

“The lordship will recall we have complained in our application of incomplete disclosures as to Section A, however, on Friday after (the State) provided my attorney with documents which they believe are outstanding from Section A.”

The matter has been postponed to 28 March 2024 to allow the defence and State to hash out the details.
