DURBAN - The Pietermaritzburg Magistrates Court has dismissed an application by an IEC official accused of stealing votes.

Musawenkosi Mnikathi was the area manager of the Imbali area during last year’s general election.

He is facing charges linked to the transportation of ballot boxes without police supervision.

Mnikathi returned to the Pietermaritzburg Magistrates Court on Tuesday where he learnt that his application to have the charges against him withdrawn had been dismissed.

In its ruling, the court said he had a case to answer to.

This means the trial against him will continue in January.

The court decision was well received by the uMkhonto weSizwe Party leaders, who came to court in their numbers.

KwaZulu-Natal MK Party convenor, Willies Mchunu.

"Justice has to be seen to be done and in this case they did a service to the nation by ensuring that the law is never bridged by anyone, whether it’s a state institution or anyone within this government. The law must take its course in this matter and we are very pleased as uMkhonto weSizwe and feel vindicated."

The matter has been postponed to 21 January for trial.
