Bail application reserved in case of Mfuleni cop accused of rape

CAPE TOWN - Judgment in the bail application of a police Constable from Mfuleni Police Station in Cape Town has been reserved until Thursday.
The 41-year-old South African Police Services (SAPS) member appeared at the Blue Downs Magistrates Court on Tuesday to apply for bail.
He is accused of sexually assaulting a female detainee at the police station on November 28.
The 26-year-old victim alleges that the accused raped her, in an empty cell and then took her back to her cell where she was locked up with seven other women.
The victim was detained on kidnapping and attempted murder allegations.
The lawyer for the police constable says his client will tell the court that he and the complainant had consensual sex.
The defence claims that the victim agreed to have sex with the accused with the hopes that he would help her with her case.
The state however refutes this version and paints the accused as a man with a long history of abuse.
The state claims the accused tried to rape a female detainee at the police station in March 2021.
He was also allegedly under the influence of alcohol while on duty.
The matter was reported to the station commander who then sent him home after smelling alcohol on him.
A decision on whether he will be granted bail will be handed down on Thursday.
