JOHANNESBURG - ActionSA has welcomed reports of a subpoena filed by the National Prosecuting Authority (NPA) against the Department of Justice and Constitutional Development for access to evidence collected from the State Capture Commission.
National Director of Public Prosecutions Advocate Shamila Batohi revealed that the prosecuting authority was being hindered from accessing the records.

However, the ministry hit back at Batohi, revealing that its investigators were trained, and access was granted in 2020.
This comes amid criticism that the NPA has failed to secure a single conviction in the state capture cases.
ActionSA is calling on the parties to pull their weight to ensure that those guilty of state capture face the full might of the law.
“Everything that we have seen so far in relation to the prosecution of state capture cases has been a sideshow,” said the party’s Stakeholder Relations Director, Solly Moeng.
“It’s about time that everybody who is being paid, who is mandated to deliver for the people of South Africa, does so. This starts with the NPA under Batohi, which has so far been making excuses after excuses after excuses. The Department of Justice must also make sure that it unlocks the safes and makes the information available.”
