COJ will not appeal Gauteng High Court order to set aside Brink's appointment
The City is now expected to appoint an acting City Manager as per the court order and advertise the post.

JOHANNESBURG - Eyewitness News understands that the City of Johannesburg will not be appealing the order of the Gauteng division of the High Court that set aside the appointment of its City Manager, Floyd Brink.
This means Brink has until Saturday to vacate the position after the superior court gave him 10 days to do so.
The City is now expected to appoint an acting City Manager as per the court order and advertise the post.
This is after Judge Stuart Wilson found that he was not properly appointed and set his appointment aside.
It’s the end of the road for Brink after consultations in a late-night meeting of the African National Congress’s (ANC) Regional Executive Committee (REC) determined that there were no prospects of success should the city forge ahead with an appeal.

The legal challenge was launched by the Democratic Alliance (DA) following Brink's appointment.
The party argued that the permanent vacancy had to be readvertised as required by the council's own resolution it passed in August 2022.
Sources have revealed that current Joburg company CEO, Helen Botes is being considered for the post despite pushback from some within the ANC’s REC for an appeal to keep Brink in the position.
