CAPE TOWN - Alleged underworld gang boss - Nafiz Modack - will seek to have the charges against him withdrawn when the high-profile trial resumes next year.

The charges include the murder of top cop Charl Kinnear — who was shot dead outside his Bishop Lavis home in September 2020.
Defence attorneys for Modack and his 14 co-accused are set to make applications for the charges against their clients to be withdrawn.
This comes after the state wrapped up its case against Modack and his co-accused a week ago.
Attorneys for the accused believe the state has not produced enough evidence to prosecute their clients successfully.
Defence attorney advocate Bashier Sibda requested more time to prepare his application for Modack, who faces the bulk of the 122 charges against the accused.
Judge Robert Henney granted Sibda's request and postponed the matter to 21 January 2024.
