The trial is set to proceed with the accused making applications to be discharged.
Last week Friday, one of the co-accused, former Anti-Gang Unit (AGU) officer Ashley Tabisher, was released on bail after being in custody since his arrest in May 2021.
Tabisher is charged for allegedly agreeing to take payments from co-accused Amaal Jantjies to be an inside man for Modack.
He insists he was following orders from former AGU head Andre Lincoln, who allegedly used Jantjies and co-accused Jannick Adonis to get information on Modack.
