JOHANNESBURG - Disgraced doctor Nandipha Magudumana's quest for freedom continues in the Supreme Court of Appeal on Thursday.

Magudumana, who is facing charges including fraud, violation of a corpse, corruption, and defeating the ends of justice, wants the appeals court to declare her arrest in April last year unlawful. 

She and convicted rapist and murderer Thabo Bester allegedly fled the country after his brazen escape from the Mangaung prison over two years ago, where he was serving a life sentence. 

The pair and seven others, including Magudumana's father, are being tried in the Bloemfontein High Court for the escape.

Magudumana's bid in the Supreme Court is her second attempt at securing her release from custody and having her arrest declared unlawful. 

Last year, the high court dismissed her application on the basis that she gave consent to be returned to South Africa where her arrest was effected. 

But her lawyers will dispute this in court to argue that Magudumana's disguised extradition was unlawful, and she could not consent to an unlawful process. 

Her lawyers will also argue that South Africa, together with Tanzanian officials, evaded Southern African Development Community (SADC) protocol on extradition. 

Magudumana wants the high court's order to be set aside with costs.
