JOHANNESBURG - Sekhukhune United footballer Shaune Mogaila has been released on R20,000 bail following his arrest on Wednesday. 
 
Mogaila faces charges of culpable homicide, reckless and negligent driving, and fleeing the scene.
 
All the charges are linked to a crash involving his luxury vehicle and a car carrying nine-year-old Gomolemo Mavimbela, her mother Keo, and a 13-year-old neighbour. 

Tragically, Gomolemo lost her life in the incident.
 
During Friday’s proceedings, the State did not oppose Mogaila’s bail. 
 
His defence team argued for a reduced bail amount citing his limited income.
 
His attorney Octavius Magunda claims Mogaila reportedly earns R40,000 per month, with significant financial commitments including a monthly BMW payment of R8,500, a R13,500 bond, and support for his family.
 
Magistrate Hlengiwe Malevu: "They’re still further investigations that the state has to do, there is still outstanding video footage, post-mortem results and a medical report.”
 
The case has been postponed to 4 February 2025 for further investigations and the submission of medical reports.

VICTIM'S FAMILY DISAPPOINTED WITH NPA

The family of nine-year-old Gomolemo is disappointed with the State's handling of the criminal case.

It decided not to oppose the suspect’s bail application.

During proceedings, the National Prosecuting Authority explained it saw no legal grounds to prevent Mogaila’s release, despite the culpable homicide charge - a Schedule 7 offence.

Speaking outside court, Gomolemo’s uncle expressed his concern, saying the family expected a stricter approach from the prosecution.

“I too was expecting more, but prosecutors, magistrates and judges, they know what to do and take the decision. We will see what happens in the future.”
