Action group wins as court rules private pool blocking Hermanus Cliff Path is on public land
The Western Cape High court has ruled that the privately built pool at Bayview apartments in Hermanus was built on public property.

A privately built pool, terrace and outside entertainment area at Bayview apartments in Hermanus in the Western Cape has received many complaints from the public. Complainants argue it stands in the way of completing the Hermanus Cliff Path.
The Hermanus Cliff Path is a 12-kilometer path that follows the coastline from Hermanus’ new harbour to Grotto Beach.

The Western Cape High Court ruled that this pool and surrounding areas were built on coastal public property.
The chairperson of the Bayview Body Corporate said they accepted to ruling and would ‘walk away from the pool.’
This means they will no longer maintain it and will leave it to the elements.
De Waal says they hope to finish the path next year.
“We can now build over there and connect the rest of the path.”
