The Western Cape High Court's former Judge President was appointed to serve on the JSC by the National Assembly in July, five months after he was impeached for gross misconduct.

JOHANNESBURG - The Western Cape High Court has barred the former Judge President, John Hlophe, from taking up a seat at the Judicial Service Commission (JSC).
 
The uMkhonto weSizwe (MK) Party parliamentary leader was appointed to serve on the JSC by the National Assembly in July, five months after he was impeached for gross misconduct.

The Democratic Alliance (DA) led an urgent application brought by several advocacy groups to interdict Hlophe from serving on the JSC.
 
Judge Johannes Daffue handed down judgment on Friday.

"Pending the determination of the merits of the applicant's review of the National Assembly's decision to designate Dr Hlophe as is representative to the Judicial Service Commission, either in part B of this application or by the Constitutional Court in case CCT2532024, and/or in case CCT2222024, whichever occurs first, Dr Hlophe is interdicted from participating in the processes of the JSC."
