Corruption case against Zizi Kodwa and co-accused again postponed

The matter was back in court on Tuesday for a decision from the Director of Public Prosecutions (DPP) on Mackay's application to have charges against him dropped, however, it was revealed in court the DPP never received his application.

JOHANNESBURG - The corruption case involving the former African National Congress (ANC) national spokesperson, Zizi Kodwa, has been delayed once again following an administrative mix-up with his co-accused Jehan Mackay.

The matter was back at the Palm Ridge Specialised Commercial Crimes court on Tuesday, for a decision from the National Director of Public Prosecutions (NDPP) on Mackay's application to have charges against him dropped.

However, it was revealed in court the NDPP never received his application.

Mackay, the former boss of EOH, is accused of paying Kodwa R1.7 million in tender kickbacks between 2014 and 2016.

Mackay’s legal representative, Ian Small-Smith, said an application to have his client's charges dropped was sent to the NDPP’s building on 13 August 2024.

He said a similar application was sent to the regional head of the Specialised Commercial Crimes Court unit, which was later rejected.

Small-Smith said protocol dictates after the application was rejected by the regional head, it would be escalated to the NDPP.

“In my client's mind it was submitted a month ago, I absolutely accept the word of the DPP that he hasn’t received it yet. We are going to resubmit and slightly bolster it because we now have the added advantage that Mk Nkoana (regional head of Specialised Commercial Crimes Court) has given us reasons why he rejected it. I plan to have the representations this week submitted to Mr Chauke (DPP).”

The matter has been postponed to 3 October 2024 for the NDPP’s decision.
