Court to hear Mkhwebane bid to get R10m gratuity from Office of the Public Protector

JOHANNESBURG - The court battle over the R10 million gratuity former Public Protector Busisiwe Mkhwebane wants from her erstwhile office continues on Monday.
Previous Public Protectors have received an end-of-service gratuity on their exit in line with the conditions of service passed by the National Assembly in 2002.
But having been impeached by Parliament in September 2023 a month before her term should have come to an end, Mkhwebane hasn’t received hers.
Mkhwebane has said she was struggling to make ends meet and earning significantly less than she was in her new role as an Economic Freedom Fighters (EFF) MP and insisted the gratuity was due to her.
But the Office of the Public Protector’s position is that this isn’t the case because of the way in which she left office.
Mkhwebane filed an urgent case against her former office in the High Court in Pretoria in March.
The following month, though, it was removed from the urgent roll and sent to the deputy judge president to consider where to place the case.
It’s now set to come before Judge Omphemetse Mooki on Monday.
It’s set down to be heard on Monday and Tuesday.
