CAPE TOWN - Two men linked to a foiled cash-in-transit robbery in Cape Town have appeared in court for their alleged role in planning the heist.

Five men were arrested last week Monday during a police operation in Khayelitsha for allegedly planning to rob a cash van in the township.

Three of them appeared at the local magistrates court on Thursday, however, the case against all five was struck from the court roll.

The court said the accused were not charged within 48 hours after being arrested, as required by the law.

Twenty-four-year-old Sihle Mabhongo and 46-year-old Simphiwe Mzanywa were in hospital at the time after being wounded in a shootout with police.

They were re-arrested on Monday.

Western Cape Hawks spokesperson, Siyabulela Vukibi, said that Mzanywa appeared briefly in court on Tuesday and the case was postponed to Thursday.
 
"The two are charged for possession of illegal firearms and ammunition, possession of explosives and attempted murder. The matter is postponed to Thursday, 15 August 2024 for bail, profiling and monitoring of Mabhongo's progress in hospital."
