Botha - who denies attacking the nursing student - made a Section 174 - application to have the case against him withdrawn.
The National Prosecuting Authority's spokesperson Eric Ntabazalila explained why Botha's application was denied.
"The emphasis is that there is a case for him to answer. That's why his application for the case to be thrown out of court failed. There is evidence which links him to the case."
The matter will be back in court on the 2 August 2024, when Botha is set to testify.
