EFF SG Marshall Dlamini to remain MP after 18-month suspended sentence and fine
According to Section 47(e) of the Constitution, candidates sentenced to more than 12 months of imprisonment without the option of a fine are ineligible to be an MP.

JOHANNESBURG - The Economic Freedom Fighters (EFF) secretary general Marshall Dlamini will remain a member of Parliament (MP) following his sentencing by the Cape Town Regional Court.
On Friday, Dlamini was sentenced to 18 months imprisonment, suspended for five years, and slapped with a R6,000 fine for malicious damage to property.
This relates to his 2019 conviction over the assault of a police officer on the sidelines of the State of the Nation Address.
Dlamini has escaped losing his seat in Parliament following the sentence.
According to Section 47(e) of the Constitution, candidates sentenced to more than 12 months of imprisonment without the option of a fine are ineligible to be an MP.
The fine has rendered him eligible to retain his seat in the National Assembly.
The EFF said Dlamini would continue to exercise his duties as an MP and a leader of the political party.
