JOHANNESBURG - Economic Freedom Fighters (EFF) leader Julius Malema continued laying into the State at his firearm discharge trial in the East London Magistrate's Court on Thursday, going so far as to label his prosecution an abuse of power.

Malema has been charged with various offences over his alleged firing of a live weapon on stage at an EFF rally in Mdantsane in 2018.

Security official, Adriaan Snyman, has also been charged, with the State alleging he gave Malema the "weapon".

Malema insisted it was a toy gun and all part of an "act", but State advocate Joel Cesar on Thursday put it to him that this was not true.

"An incompetent, incoherent, inferior prosecution is what you're trying to prove here - an abuse of power. You’ll not win with me," Malema rebutted.

"This act can be performed anywhere. I can even go perform it on the grandstand if you wish. Anywhere. There’s no prescription by the law."

The matter will return to court in November for arguments.
