CAPE TOWN - Fresh from an Electoral Court blow, founder of the uMkhonto weSizwe (MK) Party, Jabulani Khumalo will on Thursday approach the Western Cape High Court in another attempt to represent the party in Parliament.
Khumalo wants the court to interdict Parliament from removing him as a candidate to be sworn in as an MP on Friday.
But he's already lost another court battle over the party leadership.
Once the unknown name behind the nascent uMkhonto weSizwe Party, Khumalo has in just a few weeks been engaged in several legal battles with the party that's booted him out.
On Wednesday, the Electoral Court dismissed his application in which he claimed he was wrongfully removed as the party leader.
On Thursday, Khumalo will ask the High Court to stop his party and its leader, Jacob Zuma, from expelling him.
In papers filed with the court, Khumalo said that his expulsion was illegal and he was not subjected to any internal party processes.
He said that Zuma had no authority to expel him.
Parliament has already informed Khumalo that he’s been removed from the list of MK candidates to be sworn in as MPs, based on communication from the party that he's no longer a member of.
The MK Party has also informed Parliament that none of its 58 members will be arriving for the first sitting on Friday, to be sworn in as MPs.
