DURBAN - Lawyer for accused one and five in the murder case of rapper Kiernan “AKA” Forbes and celebrity chef Tebello “Tibz” Motsoane has accused the State of not having its house in order regarding the matter.
Five of the seven men accused of killing Forbes and Motsoane are applying for bail.
Advocate Simphiwe Mlotshwa said the State doesn’t have a strong case, citing incomplete investigations.
On Thursday, both the defence and State presented closing arguments for bail at the Durban Magistrates Court.
Mlotshwa raised concerns over what he’s termed a “generic” approach by the State on the matter.
“There is a huge time lapse between the arrest of all the applicants and the alleged incident.”
The lawyer for accused one, Thabani Mkhwanazi, and accused five, Lindo Ndimande, criticised the State’s handling of the case.
“The State is not taking this court into full confidence in terms of particularising in the light of the time lapse between the alleged incident and the date of arrest - what is it that is still outstanding?”
Proceedings continue with lawyers for accused two, three and four set to also present their arguments.
