CAPE TOWN - Former President Jacob Zuma's MK Party says its confidence in the Electoral Commission (IEC) has waned.

The IEC has approached the Constitutional Court to seek clarity on whether Zuma can contest as a candidate in the upcoming elections.

The commission made the move after being dealt a blow at the Electoral Court last week when its decision to stop Zuma from contesting was overturned.

Zuma is number one on the MK Party's list, an indication that he intends to go back to the National Assembly.

But the Electoral Commission argued that the Constitution prohibits anyone sentenced to more than 12 months' imprisonment from running for office.

Zuma's sentence was remitted last year, ultimately making him a free man.

The MK Party believes the IEC's journey to the apex court, has compromised electoral integrity and independence.

The party says the move signifies a rushed and potentially influenced judgment.
