AfriForum wants judge recused from 'Shoot the Boer' appeal case

JOHANNESBURG - AfriForum’s legal team is set to appear before the Supreme Court of Appeal (SCA) on Thursday to argue for Judge Raylene Keightley’s recusal from the "Shoot the Boer" case.
In 2022, the Pretoria High Court dismissed the lobby group’s hate speech case against the EFF over the party’s use of the struggle song, Dubul’ Ibhunu, which translates to "Shoot the Boer".
AfriForum’s now brought an appeal in the SCA but it wants Keightley, who is acting in the court at the moment, off the panel deciding the matter.
This is because of comments she made about the group during previous litigation around the language policy at UNISA, which AfriForum maintains gives rise to a reasonable apprehension of bias.
The group’s Kallie Kriel: "We decided on this action after it came to our attention that the judge, during a court case in 2018, made very negative remarks regarding AfriForum. She even stated that if she presides over an AfriForum case in future, AfriForum might find it appropriate to ask for a recusal.
"We hoped she would have recused herself voluntarily, she did not do so and that’s why we’re going ahead with legal action."
