JOHANNESBURG - The Judicial Conduct Tribunal hearings into the suspected misconduct of Judge Nomonde Mngqibisa-Thusi will be held in camera.

Mngqibisa-Thusi was suspended by President Cyril Ramaphosa in June last year - following a complaint by Gauteng Judge President Dunstan Mlambo.

This was on her failure to hand down a significant number of judgements timeously.

Despite it being common practice that hearings of this kind are held in public, Mngqibisa-Thusi’s legal team invoked parts of the Judicial Services Act that limit the persons who can be in attendance.

Speaking on her behalf is Justice Gcinumuzi Malindi: “Basically, the notice requests that the tribunal adheres to the default position of sections 29 and 24 of the act which state that the default position is that proceedings of the tribunal are held in private and they’re confidential unless the tribunal decides otherwise.”

Chair of the tribunal retired Judge Chris Jafta acceded to the request asking members of the media to leave the house. 

He encouraged them to bring a formal application to cover the proceedings.

If found guilty of gross incapacity or gross misconduct – Mngqibisa-Thusi will face possible impeachment.
